What was Paul’s situation before working with Advocacy Focus?

Paul* moved into a care home after a sudden stroke. A Deprivation of Liberty Safeguards (DoLS) application was made so the restrictions on him could be legally approved.

Paul felt low and unhappy about being there. When Paul first met his Advocate, he showed – using the limited communication he had at the time – that he wanted to go home. He did not agree with the restrictions and did not feel the care home was right for him.

What did the Independent Advocate do to help?

Paul’s Advocate took time to explain the DoLS process in a clear and simple way. This helped Paul understand his rights and what could happen next.

Paul was clear from the start that he wanted to return home and challenge the DoLS under Section 21A. Paul’s Advocate arranged for a solicitor straight away, and the legal challenge began.

As time went on, Paul’s movement and communication improved. At times, the process felt slow, which made him feel low again. Paul’s Advocate supported him by breaking things down into small, manageable steps. This included suggesting short visits out with family and helping professionals plan how time at home could be safely tested.

What was the outcome?

Paul’s Advocate worked closely with the social worker, care home staff, and legal teams. Together, they agreed on an eight-step plan to try Paul at home.

This began with one day a week at home and slowly increased. Paul then spent two full weeks at home before the final Court of Protection hearing. At each step, reviews and risk checks were carried out to make sure Paul was safe and supported.

As the plan moved forward, Paul’s mood improved. He felt reassured that he was being listened to. Everyone involved agreed that returning home full-time, with a Court of Protection DoLS order in place, was the least restrictive option.

Why was advocacy support so effective?

Without an Advocate, it is likely that he would have stayed in the care home. Paul’s Advocate made sure he was listened to at every stage and worked with professionals to represent his wishes and feelings.

Because of this support, Paul was able to return home to live with his partner, with the right support in place and in a way that felt right for him.
